We got our butts kicked on Tuesday. Democrats hold control of the House and the Senate. While Trump is still president and there are still enough Republicans in the Senate to use the filibuster, it’s still not great.
What’s more, we’ve been here before, and we got the Bipartisan Safer Communities Act during that time, though things are a bit different now and we’re a bit less likely to see a repeat performance.
Still, Democrats can be sneaky (yes, so can Republicans, but we’re not talking about them right now). They might figure out some way to get something through, and that’s bad news.
The Second Amendment Foundation, however, has issued a bit of a warning.
The Second Amendment Foundation is not rolling over to play “dead” following Tuesday’s devastating midterm election results which, as some in the gun rights community acknowledge, turned out worse than even the polls indicated.
Instead, SAF has thrown down the gauntlet with a post on ‘X’ declaring, “SAF reminds any newly elected lawmaker that the enshrinement of constitutional rights necessarily takes certain policy choices off the table. Make us sue you, and we will.”
Whether these new members of Congress take that as a warning or challenge remains to be seen, but considering SAF’s history of litigation, it is most likely the first option.
The Constitution is intended to protect the bedrock of fundamental rights enjoyed by all Americans. When political winds shift, that bedrock becomes even more critical. Supreme Court caselaw is perhaps the best buffer between the People and temporary political majorities. This is precisely why cases like our two Assault Weapons Ban cases pending before the Supreme Court as so critical. Oral arguments are on December 2nd. https://t.co/jFRVvAikoV

The organization’s ‘X’ message explains, “The Constitution is intended to protect the bedrock of fundamental rights enjoyed by all Americans. I don’t like trusting everything to the courts, but the reality is that the courts are consistently where the real victories are obtained. It’s a lot easier to roll back oppressive gun control laws via judicial mechanisms than to get a bunch of members of a legislature to actually get off their butts and do something they believe is right but that might not be popular.
Popularity über alles for politicians.
But in the courts, lifetime appointments provide shields for judges who can clearly see these laws are unconstitutional under the existing precedents, and don’t have to worry about popularity. Well, not much. They’re still people and can only take so much heat personally before they start to bend, but you get the point. That’s why these judges have lifetime appointments, and it’s the big problem with a lot of state supreme courts. Those justices have to campaign for office every so many years.
The Second Amendment Foundation issued what is ultimately a warning that they intend to keep doing what they’ve been doing.
The downside is that it won’t deter a soul. Anti-gun Democrats won’t be footing the bill for the lawsuit. That’ll be on us, the American taxpayer, and when have you ever seen a Democrat who wasn’t interested in spending taxpayer money?
Editor’s Note: The radical Left will stop at nothing to enact their extreme gun control agenda and strip us of our Second Amendment rights.
